Examinations for Discovery: Building Block Series

The Advocates’ Society

Building Blocks: Examinations for Discovery series was developed by leading litigators and Advocates’ Society Excellence in Teaching Award winners Sandra Barton and Tom Curry, in consultation with members of our Young Advocates’ Standing Committee. This interactive and practical series will help take your examinations for discovery to the next level.

Block One will be held on October 11, 2023, Block Two will be on November 14, 2023, and Block Three on December 12, 2023. Block Four, the learning-by-doing skills workshop, will be held on January 16, 2024. Click here to learn more about the program.

When it comes to examinations for discovery, failing to prepare, is preparing to fail.

Block One: Theory, Strategy and Preparation

Find out how to properly plan for discovery and strategically use every step of the process to your advantage.

Get to know the rules and objectives of the discovery process, how to develop a winnable theory and strategy, and receive practical tips for preparing yourself and your witness for discovery.

You will also have the chance to participate in a small group breakout session, facilitated by a leading practitioner, to help you develop an effective examination strategy and roadmap for discovery.

In preparation for the session, you will be asked to review and evaluate a case file from the perspective of either the plaintiff or the defendant. You will then work with your peers in small groups to develop a plan for getting the most out of the discovery process. This exercise will encourage critical thinking and active participation in a safe and supportive learning environment and is intended to help you get the most out of the program.

Section 85, 86 and 51 Rollovers – What You Need to Know
