As litigation lawyers with many decades of experience, we know that sometimes the best results are achieved outside the court room. An alternative dispute resolution (ADR) approach, such as mediation or arbitration often achieves better results than traditional litigation and, in many cases, will be faster, more confidential, and less costly.
Mediation is now a well-established step in the litigation process in Ontario and our litigation lawyers bring clear analysis and practical, results-oriented thinking to the mediation table.
Arbitration is often the only forum available to clients who find themselves in a dispute originating with a commercial lease or commercial agreement. Our litigators will work with you as your advocate throughout the process, from the initial draft of the arbitration agreement, through to the arbitration hearing.
In addition to acting as skilled advocates on behalf of our clients at mediations, some of our senior litigation and construction lawyers are also available to conduct mediations. They have undertaken additional education and training in ADR which qualifies them to take on the role of independent mediator. They are able to use their industry and practice area expertise and ADR training to benefit those involved in difficult, seemingly intractable disputes assisting them to reach a sustainable resolution.
